Abstract

The article considers one of the most controversial problems of modern law which is the provision of integrity of precedents by means of official recognition of precedent character of legal position of higher courts. On the basis of legal positions of Higher Arbitration Court of the Russian Federation the author comes to the conclusion, that in terms of society and state reforming, imperfection of legislation, legal positions stated by higher judicial authorities fulfills the function of a regulator of public relations and provide their stability at the same time.
