Abstract |
The article considers contract under civil
legislation of the Russian Federation to be a form
of law (source of law). The author shows the
difference between a transaction as an act of the
parties and a contract as a regulator of social
relations. By means of transaction the terms of the
contract approved by the parties come into effect.
From the viewpoint of neopositivism approach to the
law the terms of a contract can be considered as
legal instructions of a particular character. In
this case a contract as a regulator of social
relations is a form of law with particular legal
instructions. |
