Abstract |
The article reveals the notion of sub-branch of law
as a legal phenomenon and the element of legal
system. The review of understanding of a sub-branch
of law is given. The conclusion on the fact, that
one can judge of a sub-branch of law when followed
criteria, is made. These criteria are the following:
sub-branch includes the set of uniform institutions
integrated into a sub-branch within a specific
sector of law characterized by peculiar features and
fungible isolation; among the components of a
sub-branch there is a common institution, groups of
institutions, general provisions for the
institutions of a sub-branch legally stated or
general standards association; uniformity of public
relations united into a sub-branch, at the same time
there should be a diversity of public relations; a
sub-branch is characterized by a high level of
specialization and differentiation of its legal
institutions. |
