Abstract

The article deals with rule-making of the Customs in the sphere of administrative competence. In the Russian doctrine of Administrative Procedure Law rule-making of the customs authorities is one of the most controversial in administrative competence. The author analyzes the system of legal acts governing administrative jurisdictional actions of the customs authorities. Based on the analysis of different views of scholars introduced in references the conclusion is made on modernization of administrative jurisdictional actions of the customs authorities which is to fulfill by means of a simple typology of the structure of legal system of administrative competence of the customs authorities. The author believes that this purpose allows us to achieve desired results of decrease in the number of department legal acts in the sphere of administrative competence of the customs authorities.
