Abstract

Problematic issues on delimitation of law violation from abuse of rights in criminal procedure are considered. The conclusion on the fact that abuse of rights in criminal procedure is not a law violation but a separate legal phenomenon is proved. The conclusions of the author are proved by the examples of judicial practice.
